Terms of Use
The terms for using wachiman.dev and its documentation, and how they relate to the license of the Wachiman software.
Last updated: 2026-11-02
Change on 2026-11-02: these Terms now name Niway S.A.C. as the operator, are governed by Peruvian law with the courts of Lima, set a USD 100 liability limit and require users to be 18 or older.
These Terms apply to your use of wachiman.dev and its documentation pages (the “Site”). They do not govern the Wachiman software, which is licensed separately (section 2). If you do not agree with them, do not use the Site.
Wachiman reviews pull requests with an AI model. It runs inside your own GitHub Actions, with your own API key. NIWAY does not host a review service, so there is no account to create and no service to subscribe to.
1. Who we are
Section titled “1. Who we are”The Site is operated by NIWAY (Niway S.A.C., a company incorporated in Peru and based in Lima, Peru). In these Terms, “NIWAY”, “we” and “us” mean that company. You can write to us at contact@niway.com.
2. The software has its own license
Section titled “2. The software has its own license”The Wachiman software is published at
github.com/niway-dev/wachiman. Your right to use, copy,
modify and share it comes from the license in the
LICENSE file that ships with the version
you use. Different versions can carry different licenses, and a version’s license is the one in its
own LICENSE file. The License page explains which versions carry which license.
These Terms do not add conditions to that license and do not take rights away from it. If anything in these Terms conflicts with the license about the software, the license prevails.
3. What Wachiman is, and what it is not
Section titled “3. What Wachiman is, and what it is not”Sections 3 to 6 describe how Wachiman works and who is responsible for what. They allocate responsibility between you and NIWAY. They are not conditions of your license to the software.
It is advisory. Wachiman posts its findings as ordinary GitHub review comments. It does not approve a pull request, request changes or block a merge. A label such as “Blocker” is a label on a comment, not a status that GitHub enforces.
Its output is AI-generated and can be wrong. Findings come from an AI model. They can be incorrect, incomplete or miss serious problems, including security problems. A statement that files were reviewed is the model’s own report, not a measurement of what was read. Wachiman does not replace a human review, testing or a security audit. People decide what to merge, and they are responsible for that decision.
It is not professional advice. Nothing on the Site or in a review is legal, security or compliance advice.
4. Your API key, your provider and your costs
Section titled “4. Your API key, your provider and your costs”Wachiman runs with an API key that you provide to your own GitHub repository. NIWAY does not receive your key and does not operate a service that receives it.
- Your provider bills you. Model usage is charged to your account with the provider you choose, such as Anthropic or OpenAI. GitHub charges you separately for Actions minutes, under your plan.
- Budget settings are guard rails. Depending on the provider, a call can cost more than the limit set for it. The cost printed in a review is Wachiman’s own estimate, not an invoice. If you need a hard ceiling, set a spend limit with your provider.
- Your provider’s terms apply. Your use of a model provider is governed by that provider’s terms, usage policies and privacy practices. You are responsible for complying with them. NIWAY is not a party to them.
5. Your code, your repository and your CI
Section titled “5. Your code, your repository and your CI”When Wachiman runs, content from your pull request, such as the diff and the files the reviewing agent reads, goes to your model provider from your runner. NIWAY does not operate a service that receives it.
You are responsible for:
- deciding whether your code may be sent to your provider, and whether you have the right to send it;
- choosing which repositories run Wachiman and who can push to them;
- your workflow configuration, your repository secrets and your GitHub Actions settings;
- choosing which version of Wachiman you run, and reading a release before you upgrade to it.
6. Security
Section titled “6. Security”Wachiman is not a sandbox. Install it only where everyone who can push to the repository is someone
you trust with your API key, and do not use it to review code from people you do not trust. Read
SECURITY.md, including its list of
what has not been verified, before you decide. The hardening it describes is limited to what has been
tested and is not a guarantee against a malicious branch.
Reporting a vulnerability in the software. Report it privately, as described in
SECURITY.md, through GitHub’s private
vulnerability reporting. Please do not open a public issue for a security problem. Wachiman is a
one-person project, so reports are handled on a best-effort basis, with no service-level commitment.
Reporting a problem with the Site. Write to contact@niway.com with “Security” in the subject. Do not include API keys or other secrets in the message.
7. Using the Site
Section titled “7. Using the Site”You must be 18 or older and able to enter into a contract, or you must use the Site on behalf of an organization that authorizes you to do so.
You may read the Site, link to it and share it. You agree not to:
- overload, scrape in a way that degrades, or interfere with the Site or the infrastructure that serves it;
- try to gain unauthorized access to the Site, its hosting or other people’s data;
- use the Site in a way that breaks the law or other people’s rights;
- suggest that NIWAY endorses, sponsors or is affiliated with you or your product, except as the Trademark Policy allows.
8. Intellectual property and trademarks
Section titled “8. Intellectual property and trademarks”The software and the documentation published in its repository are covered by the license in that repository (section 2).
The rest of the Site, including its text, design and illustrations, belongs to NIWAY, and all rights are reserved. You may view and link to it, and quote short excerpts with attribution.
The Wachiman name, logo, character and wachiman.dev domain are covered by the Trademark Policy. Nothing in these Terms grants trademark rights.
GitHub, Anthropic, Claude, OpenAI and other third-party names belong to their owners. Wachiman is not affiliated with, endorsed by or sponsored by them.
If you send us feedback or suggestions, you keep ownership of them, and you allow us to use them to improve Wachiman without obligation to you or payment.
9. Third-party services and links
Section titled “9. Third-party services and links”The Site links to services we do not operate, such as GitHub and model providers. We do not control them and are not responsible for their content, availability or practices. Their own terms and policies govern your use of them. A link is not an endorsement.
10. Privacy
Section titled “10. Privacy”How the Site handles personal data is described in the Privacy Policy.
11. No warranty
Section titled “11. No warranty”NIWAY currently charges nothing for the Site. To the extent the law allows, the Site and its documentation are provided “as is” and “as available”, without warranties of any kind, express or implied. We do not promise that the Site will be available, that it will be free of errors, or that the documentation is complete or current. If a page on the Site differs from the files in the repository, the repository’s files for the version you use prevail.
The software is provided under the warranty disclaimer in its own license (section 2).
12. Limit of liability
Section titled “12. Limit of liability”To the extent the law allows:
- NIWAY is not liable for indirect, incidental, special or consequential damages, or for lost profits, data or goodwill, arising from the Site or from your use of Wachiman;
- in particular, NIWAY is not liable for losses that come from decisions you make based on Wachiman’s findings, from defects it misses, from charges made by your model provider or GitHub, or from your own repository, workflow, secrets or choice of what to run Wachiman on; and
- NIWAY’s total liability for all claims relating to the Site or these Terms is limited to USD 100.
These limits do not apply to liability for intentional misconduct or gross negligence, or to liability that cannot be limited by law. If you are a consumer, rights that the law of your country gives you and that cannot be waived are not affected by these Terms. The license limits NIWAY’s liability for the software separately.
13. Changes
Section titled “13. Changes”We may change the Site and these Terms. A change takes effect when we post it, and the “Last updated” date at the top shows when. A material change is also shown at the top of this page for at least 30 days. We keep earlier versions and will send one on request. Changes do not apply to a dispute that arose before the change, and they never change the license of a version of the software that has already been released.
14. Ending your use
Section titled “14. Ending your use”You can stop using the Site at any time. We may restrict access to the Site, for example to stop traffic that breaks section 7 or threatens its availability, and we may change or discontinue the Site.
There are no accounts to close. These Terms do not end any license granted to you for the software; a license ends only as that license says. Sections 3 to 6 and 8 to 17 continue to apply after you stop using the Site.
15. Governing law
Section titled “15. Governing law”These Terms are governed by the laws of Peru, and the courts of Lima, Peru, have jurisdiction, without prejudice to mandatory consumer protections in your country. You are welcome to contact us first to try to resolve an issue, but you do not have to before going to a court or authority. We do not require arbitration and do not ask you to waive the right to bring a claim.
16. Contact
Section titled “16. Contact”NIWAY (Niway S.A.C.), Lima, Peru. Email: contact@niway.com.
17. General
Section titled “17. General”If a provision of these Terms is found to be unenforceable, the rest stays in effect and the provision is applied to the extent the law allows. These Terms, the Privacy Policy and the Trademark Policy are our whole agreement with you about the Site. For the software, the license is the whole agreement. If we do not enforce a provision, we have not given it up. We may assign our rights and obligations under these Terms as part of a transfer of the Wachiman project; you may not assign yours without our consent. These Terms are written in English.
